Terms & Conditions
Updated January 2026. You, the "Customer" warrant that you buy our services as a business and not as a consumer. By buying from Southpaw, the Customer agrees to be bound by these terms and conditions.
1. Definitions- “Customer" means the person, company, organisation or other entity entering into the Order for the Merchandise.
- "Terms" means these terms and conditions.
- "Merchandise" means the products, articles or things or any of them subject of the Order and described in the Order.
- "Order" means the Order placed by the Customer for the Merchandise.
- "Quotation" means the Quotation, which is given to the Customer relating to the Merchandise.
- "Southpaw" means Southpaw UK, Office 9 Bramley House, Bramley Road, Long Eaton. NG10 3SX (Please be aware this is not our delivery or returns address).
- "Southpaw Made" means any Merchandise manufactured by Southpaw, either in the USA or UK.
- "3rd Party" means any product not manufactured by Southpaw, but is an item resold by Southpaw.
- Prices are subject to change without notice, are F.O.B. point of shipment, and do not include installation.
- Prices do not include Shipping, VAT or any other taxes & duties that may be applicable; however, qualifying and required taxes at the time of shipment will be added to the invoice.
- The price of any Merchandise will be as quoted on our site from time to time, in case of obvious error
- In the circumstances of an obvious error, we are are under no obligation to provide you the Merchandise to you at the incorrect price, if the pricing error is obvious and unmistakable and could have been reasonably recognised by you as a mis-pricing.
- Southpaw ships the latest design model available, which adheres to any applicable statutory or regulatory requirements. We reserve the right to amend the specification of the goods supplied, where necessary. If the amendment is deemed to be a fundamental change, you will be notified in advance.
- Since our products are constructed on a limited scale, we are often able to make special modifications to accommodate a larger client or meet a specific requirement. If you have a special request, please contact us at 0115 718 0020, this will however cause a longer lead-time for delivery.
- Due to the nature of the Merchandise, and although Southpaw makes every effort to be accurate, all sizes, weights, dimensions and measurements listed on our website have a 5% tolerance.
- Certain Products will be deemed to have parts which will "wear and tear" over the course of normal use.
- All payments must be in British sterling GBP. We accept
- cheques,
- bank transfers,
- Visa, MasterCard & Electron.
- We do not accept payment on Collection.
- Payment on credit or debit card will be processed as soon as your Order is received and your Merchandise will be dispatched at the earliest opportunity.
- Upon the dispatch of your Merchandise, an invoice shall be raised.
- Those who eligible for VAT relief must supply either supply a copy of their exemption form via email to sales@southpaw.co.uk prior to Order shipment or complete the online questionnaire during the check our process.
4. Credit Policy
- Credit is available to NHS hospitals & facilities, government agencies (such as local councils) and qualifying UK Schools, Colleges & Academies. They are not required to complete an application, but Orders must be either be received via official purchase Order on the organisations official letterhead or providing an official Purchase Order number during the website check out process.
- All other Credit requests need to be emailed in advance to sales@southpaw.co.uk.
- Our Credit terms are Net 30 days from invoice date, except for Design Proposals & Installation Projects.
- Unpaid and past due invoices will be subject to a service charge on the unpaid balance at an interest rate equal to the lesser of eighteen percent (18%) per annum or the maximum allowable interest rate under applicable law. Customer is responsible and liable for all expenses incurred by Southpaw or its associates for collection, including reasonable solicitor fees.
- Any Quotation from Southpaw is conditioned on, and shall not become binding upon Southpaw until, actual receipt of Customer’s written Order.
- Order must be consistent with these Terms and any other terms and conditions stated in Southpaw’s Quotation without qualification, and be submitted within 30 days as indicated in the Quotation.
- Merchandise is normally shipped via courier within 3 working days (Monday - Friday, excluding Public Bank Holidays) of Order acceptance.
- Orders received on non working days and Public Bank Holidays will be deemed to have been accepted on the following working day.
- For larger items, Made to Order and Special Orders, these lead times will be extended.
- If an item cannot be shipped within 30 days, we will contact you for further instructions.
- We recommend that items with extended shipping times be ordered 3 months in advance of desired delivery date.
- Shipment dates are approximate. Southpaw is not responsible for damages resulting from shipment delays or product deliveries.

- Mainland UK Domestic Customers: Orders are shipped via a Third Party courier, usually APC, FedEx or via Royal Mail, depending on size and location.
- Southpaw operate a 4 tier shipping policy in mainland UK and are based on the total value of the Order, excluding VAT, as follows:
- For Orders between £1 and £50; delivery charge: £8
- For Orders between £50.01 and £250; delivery charge: £18
- For Orders between £250 and £2000; delivery charge: £36
- For orders over £2000; delivery charge: £150
- For Northern Ireland we have a different 4 tier shipping policy, also based on the total value of the Order, excluding VAT, as follows:
- For Orders between £1 and £100; delivery charge: £25
- For Orders between £100 and £300; delivery charge: £58
- For Orders between £300 and £600; delivery charge: £100
- For orders over £600; delivery charge: £150
- From time to time large Bulk items or Special order items will be shipped via a specialist courier, whose charges will not be covered in our standard shipping policy.

Disposal of any packaging materials (including pallets) is the responsibility of the Customer, and Southpaw are unable to collect or remove it after delivery.
- Southpaw reserve the right to change these charges, as it sees fit and without notice
- Deliveries will only be conducted between 8am-6pm on normal Business Days, Monday to Friday
- Southpaw may deliver the Merchandise by several instalments and from different locations with different carriers. Each separate instalment shall be invoiced and paid for in accordance with our terms and conditions.
- POD's & Proof of Delivery. All Shipped items will be confirmed via electronic mail (email) to the address given by the Customer.
- If your Merchandise has not arrived within 7 days of the confirmation email, please contact us on sales@southpaw.co.uk or on 0115 718 0020.
- Proof of Delivery from our couriers can only be provided within 30 days of shipment date & if no claim has been made or request for POD lodged within this period, we will deem that the shipment has been received, accepted and all invoices are due and payable.
- Shipping and handling charges for Orders going to the European Union will be determined on a case-by-case basis. Please note: A 5% handling fee is charged to use third party (Customer specified) transportation.
- Mainland UK Domestic Customers: Orders are shipped via a Third Party courier, usually APC, FedEx or via Royal Mail, depending on size and location.
- Shipping charges will be quoted based on Customer’s specified mode of transportation from the U.K and must be paid at the time the Order is accepted.
- The agreed IncoTerms for the Order are "Delivered at Place" (DAP) unless otherwise stated. Southpaw will arrange the export customs declaration, whereas the Customer arranges the import customs declaration and local taxes, tariffs & duties are the Customer’s responsibility.
- If the Customer refuses receipt of the Order, or is unwilling to meet the subsequent tariffs or taxes due on the Merchandise, then the item will be returned to Southpaw. Any redelivery charges will be in addition to the original Order value.
- The costs of the transport for any returned Merchandise enacted by the Customers' failure to meet tariffs, duties or taxes will be deducted from any refund to the Customer.
- If the Merchandise is refused by the Customers' failure to meet tariffs, duties or taxes and it is commercially unviable to return the item to Southpaw, then the item will be destroyed by the Courier and a refund will not be granted.
- If products are to be exported, the Customer is solely responsible for obtaining export licenses, other necessary papers, consular and custom declarations and will accept and bear all responsibility for penalties resulting from errors or omissions thereon.If Southpaw are requested to obtain Export documents, a 30% premium will be charged on top of these charges as a management fee.
9. Damaged and Incomplete Shipments
- All deliveries should be inspected immediately before signing carrier acceptance.
- Damage description (including damage to outer cartons) and other notations must be written on the delivery receipt or bill of lading and signed by the driver.
- Retain all packaging.
- Report any damage or shortage immediately by calling our office at 0115 718 0020. Have your Customer number and invoice number available.
- All damage and shortage claims must be reported within 3 days of delivery.
- We want you to be happy with your Merchandise, if you are not and you want to return it, please let us know within 14 days of purchase.
- Once you have informed us, please return the Merchandise within 14 days of this.
- It is important that any unwanted Merchandise is returned in re-saleable condition, unused and undamaged in the original packaging.
- We will refund the delivery charge on your order if damaged and/or received incomplete, provided you return the merchandise received in full.
- If you are only returning some of the items on your order, then we will only refund you the cost of those items.
- To return an item, contact us on 0115 718 0020 to obtain a Returns Number, this number should be marked clearly on the packaging of the item being returned.
- We will require you to return the Merchandise to Southpaw in the event of a cancellation. If the Customer is cancelling using their statutory cancellation rights, then Southpaw will require the Customer to pay the cost of returning them.
- If you wish for Southpaw to arrange collection, there is a minimum collection charge of £15. This may increase if the item needs to be re-boxed or cleaned. A quote will be provided before collection due to the varying sizes of Merchandise, please call 0115 718 0020 to find out more.
- Unauthorised returns, which are returns beyond the 28 day period of purchase, do not have a Returns Number, or are not in resalable condition, the refund may be rejected or be subject to a £20 re-stocking fee.
- Once you have returned your Merchandise, it can take up to 14 days to receive your refund, but normally is much quicker than this.
- Where a product has been specially ordered, Made to Order, or you have specified a certain colour, unless faulty, we're unable to offer a refund.
- Eating, hygiene items (including brushes), inflated items (air mats etc), oral motor products and books are also non returnable.
- Return shipping expenses are paid by Southpaw only if the customer received Merchandise which is defective, was received incorrectly due to Southpaw error or being returned under warranty.
- Purchases originally made by credit card are refunded to the same card.
- Merchandise originally purchased by cheque, money Order or purchase Order will be issued a credit on Customer’s account, or a refund cheque will be issued at Southpaw’s discretion.
11. Design Proposals & Installation Projects
- All Design Proposals are developed in conjunction with the Customer using our years of experience in creating Sensory Therapy rooms.
- However there are no express or implied representations for the Design Proposals' fitness for particular purposes, nor does any part of the Design Proposal constitute advice.
- The Customer, on acceptance of the Design proposal, agrees to Clause 16. Limitation of Liability of these Terms.
- All Installation Projects require a minimum 50% deposit paid, along with an Official Purchase Order.
- All Design Proposals are based on Southpaw having unobstructed access to the required area between 7.30am and 7.00pm, Monday to Friday to complete the works. If the customer is unable to do so, Southpaw reserves the right to charge for additional hours for the works
- Installation Deposits are non-refundable, however Southpaw (where appropriate) will endeavour to return the deposit to the Customer, after deductions for legitimate expenses incurred by Southpaw (such as visits, travel expenses, design time, materials purchased). However this is on the sole discretion of Southpaw and only in cases where the Cancellation is greater than eight (8) weeks before the proposed Installation date.
- While every attempt will be made to find a suitable Installation Project date, Southpaw operates on a first come, first served basis and we cannot guarantee Installation dates (especially in regards to School Holidays).
- Any dates quoted by Southpaw in connection with the Installation Project shall be treated as estimates only. We accept no liability for failure to meet such dates and time shall not be of the essence for this purpose.
- If there are any outstanding items from the Installation Project such as repairs, remakes, items covered under warranty, training or Product delays. Then Southpaw will make a reasonable apportionment (normally the retail value of the Product) off our final invoice, until the matter has been resolved. As per Section 3, any such apportionment will not affect the remaining items on the raised invoice.
- On completion of the Installation Project, Southpaw will remove all our packaging and any rubbish we have created from the works done. It does not include removal of any existing equipment the Customer wishes to dispose of, or any other services not listed in the Design Proposal or Quote.
- Restocking fees will apply to any merchandise returned after 28 days of receipt.
- Restocking fees are waived for defective products and for merchandise returned within 28 days of receipt with proper Return Merchandise Authorisation, in the original packaging and in resalable condition.
- Southpaw provides equipment only for supervised non-recreational treatment activities.
- It is the user’s total responsibility to ensure that the equipment is properly and safely assembled and secured, used appropriately, and removed and stored when not in use.
- Our equipment should not be altered, modified or changed in any fashion.
- Instruction sheets are included with each piece of equipment and are critical to the user’s understanding and safe use.
- Replacement instruction and safety sheets are available by calling 0115 718 0020 and are downloadable at southpaw.co.uk.
- Southpaw has a proud reputation for manufacturing quality products. If you are not completely satisfied with any Southpaw made item (please ask which products qualify) you have purchased, call within 60 days of purchase date and we will provide instructions on returning the item for full credit, refund or replacement on Merchandise only, subject to the Southpaw Refund, Returns & Cancellation Policy.
- Execution of guarantees applies to private United Kingdom only.
- Special conditions and regulations apply to Customers in other international territories.
- Our new Two Year Limited Written Warranty, covers defects in materials or workmanship in Southpaw Made Merchandise ONLY for two years from date of shipment, which is extended solely to the user of the product.
- Any defects in materials or workmanship will be addressed by repairing or replacing the defective component or product at the sole discretion of Southpaw.
- Any alteration, abuse, misuse, tampering, improper repairs, negligence or use of the equipment in a manner inconsistent with the instruction and/or safety sheets is not covered under warranty.
- Outdoor use of equipment or hardware may also void all warranties.
- Warranties may be deemed void at the sole discretion of Southpaw in such instances.
- 3rd party Merchandise, resold by Southpaw, is NOT covered by our Two Year Limited Written Warranty, instead it is covered by a 1 year manufacturers warranty from date of shipment, extended solely to to the user of the product.
- Certain items, such as consumable items, will not come with a warranty, but will still be covered by our Returns, Refunds & Cancellation policy.
- Where this is the case, this will be highlighted within the product description on this website.
- Warranty does not cover conditions, damages or failures due to normal wear and tear.
- It is expected that certain items, such as bungee springs/cords for trampolines, springs for Bounce Pads/Discs, Vertical Stimulation Devices, steamroller bands will need replacing during the course of the lifetime of the product and therefore these parts are not covered by this warranty, but are covered for a period of 6 months.
- We recommend the user establish a regular inspection programme of all equipment, fittings and support systems to guard against injury.

- As a condition of any warranty claim, the Customer shall provide all reasonable assistance requested by us to diagnose and assess the reported fault. This includes, but is not limited to:
- Providing photographs and/or video recordings of the goods, installation, connections, error messages, and surrounding areas as reasonably requested;
- Carrying out first-line diagnostic checks, including checking power supplies, cables, inputs, batteries, and software or settings.
- Removing installed goods, panels, screens, or brackets where reasonably required to enable inspection of fixings, cabling, or rear components, provided the Customer has competent personnel available to do so safely.
- Undertaking reasonable remedial or investigative steps as directed by us prior to any engineer visit or replacement being authorised.
- Where the Customer has an on-site maintenance, facilities, or technical team, it shall be assumed that such investigations can be carried out by suitably competent and insured personnel.
- Failure to provide reasonable cooperation or information may result in delays to the assessment of the claim and/or the suspension of warranty support until such cooperation is provided.
- Where an engineer visit is arranged and it is subsequently determined that the issue is not due to a defect in the goods or our workmanship, or could reasonably have been identified through the investigation steps set out above, we reserve the right to charge the Customer for the visit at our prevailing rates.
- We are not responsible for the condition, integrity, or suitability of walls, plasterboard, masonry, studwork, or other mounting surfaces, nor for any failure of such surfaces.
- Responsibility for the structural adequacy of the mounting surface rests solely with the Customer.
- Our responsibility is limited to the correct selection and installation of fixings based on information reasonably available at the time of installation and acceptable use of the goods.
- We shall only be liable where a fixing itself has failed due to defective installation or workmanship under normal and intended use.
- As a condition of any warranty claim, the Customer shall provide all reasonable assistance requested by us to diagnose and assess the reported fault. This includes, but is not limited to:
17. OMI Interactive & Immersive Room Projectors

- This Merchandise is covered by a 1 Year System Warranty.
- Telephone and email support services are operated by Southpaw with fully trained support staff to help diagnose and resolve any user or technical problems that may be experienced by the Customer.
- If the problem cannot be resolved remotely, Southpaw may, at its own discretion, either arrange to supply a replacement component or book an on-site engineer call-out.
- In case of component failure, where applicable,
- The Customer will disconnect the component, and package it adequately in readiness for collection by courier.
- Southpaw will arrange a courier to collect that component, and will either replace, or repair it, and ship back to the Customer for reconnection.
- Items that are not covered:
- Consumable items (i.e., projector lamps, flooring, reflectors, etc.)
- Cosmetic damage
- Damage due to deliberate action, negligence, fire, theft or natural disasters
- Projector lamps that need replacing, a call-
out fee will apply - POA.
- The Customer will ensure staff and users are appropriately trained in the safe use of the Products.
- The Customer will not modify, repair, or use non-approved components or
accessories without the Company’s prior written consent. - Use the Products only in accordance with the User Manuals
and Product Instructions.
18. Limitation of Liability
- Our products are intended for use only by trained professionals. Although we use the finest materials, we cannot guarantee freedom from injury.
- The user assumes all risk of injury and responsibility for applicability to any client.
- All merchandise is sold under this condition, which no representative of the company can waive.
- The performance of necessary repairs or replacement of defective components or products is the sole and exclusive remedy under this warranty. Southpaw shall not be liable for indirect, incidental or consequential damages resulting from breach of the express written warranty set forth herein.
- There are no other express or implied representations or warranties, including the warranties of merchantability and fitness for particular purpose.
- Southpaw shall not be liable for indirect, incidental or consequential damages, for injuries to persons or property, or for any other loss or damage except as expressly set forth herein.
- Southpaw shall not be liable for any default or delay in performance if caused, directly or indirectly, by an act of God; war; force of arms; fire; general viral outbreak; global pandemic; the elements; riot; labour dispute; picketing or other labour controversy; sabotage; civil commotion; accident; any governmental action, prohibition or regulation; delay in transportation facilities; shortage or breakdown of or inability to obtain or non-arrival of any labour, material or equipment used in the manufacture of any product; failure of any party to perform any contract with Southpaw relative to the production of any product; or from any cause whatsoever beyond Southpaw’s reasonable control, whether or not such cause be similar or dissimilar to those enumerated.
- Neither party may assign any of its rights or obligations hereunder without the prior written consent of the other, except that Southpaw shall have the right to assign them to any company with which it is affiliated or to any corporation into which it shall be merged, with which it shall be consolidated, or by which it, or all or substantially all of its assets, shall be acquired.
- Although we try to make each Southpaw product fun to use, therapy is a serious business. Our products are not designed to be used for unsupervised play. Even a simple piece of equipment can be dangerous if used improperly.
- Our photos and suggestions are not intended to be recommendations or endorsements for any activity. It is up to the user to determine whether a given activity is safe and appropriate for the client or situation.
- Throughout the catalog we provide a recommended maximum working load for each applicable product, please do not exceed this maximum.
- Working load is the combined weight of the client and the equipment, plus the force created by motion (swinging, bouncing, rotating). Please do not exceed this maximum.
- The word “safety” as used in our catalogue is not intended to imply the product is safe in all conditions, but simply that it has been tested and approved by Southpaw (see Limitation of Liability).
- For the safety of your clients, therapists, users, etc., check your suspended equipment on a regular basis.
- Except as otherwise provided herein, any rights or remedies granted hereunder to either party shall be in addition to, and not in lieu of, any other rights or remedies of such party at law or in equity.
- The Customer shall ensure that it and all of its staff, agents, contractors and any other party performing its obligations or exercising its rights under or in connection with these Conditions and/or any other agreement that the Customer may have with Southpaw complies at all times with all applicable anti-bribery and/or corruption laws, regulations and codes of conduct in all jurisdictions. The Customer shall, whenever requested by Southpaw, provide evidence of the measures, steps and processes that it takes to ensure compliance with the provisions of this Condition and the relevant laws, regulations and codes of conduct.
- This document contains the entire agreement between Southpaw and Customer and constitutes the final, complete and exclusive expression of the terms of the agreement, all prior or contemporaneous written or oral communications, agreements, forms or negotiations with respect to the subject matter hereof being merged herein. By way of illustration and not limitation, Customer’s Order shall be deemed to incorporate, without exception, all terms and conditions hereof notwithstanding any Order form of Customer containing additional or contrary terms or conditions, unless Customer shall have expressly advised Southpaw to the contrary in a writing apart from such Order form, and no acknowledgement by Southpaw of an Order by Customer shall be deemed to be an acceptance by Southpaw of any such additional or contrary terms or conditions thereof which are in addition or contrary to the terms and conditions hereof. No additional or contrary terms or conditions or modifications may be made to these terms and conditions except by a written instrument signed by one of Southpaw’s officers. Stenographic and clerical errors are subject to correction by Southpaw.
- Both parties expressly agree to waive any rights that they may have under the Contracts (Rights of Third Parties) Act 1999 to bring a claim in respect of any other agreement entered into between the parties to these Conditions in relation to the subject matter of these Conditions and that any third party mentioned in these Conditions either specifically or by implication shall be expressly excluded from bringing a claim under the said Act.
- In the event that any provision hereof shall violate any applicable statute, ordinance or rule of law, such provision shall be ineffective to the extent of such violation without invalidating any other provision hereof.
- These Conditions shall be governed by and construed in all respects in accordance with the laws of England and Wales and both the Customer and Southpaw hereby agree to the exclusive jurisdiction of the English Courts in the event of any dispute in relation thereto.
